I make beads that look just like a Disney character or a component of a character? I want to make a set of beads that has Mickeys hat and Minnies bow and so forth and also I wanted to put my Jack Skellington head beads on Ebay. I have seen another bead artist do Disney themed sets but I don't think Disney was in the title.

Oh yeah, I guess that wouldn't be good. You mean Disney? I wonder if that's why I don't see those beads on ebay anymore.

Less smart ass answer:

You can probably MAKE them LOOK like the "character" and not call
it that. So, for instance, you could make Goofy beads, but list them as
"Hound dog beads" and leave all reference to Walt and his mighty
kingdom out. It would be obvious to the lay observer that they
were goofy beads - but there wouldn't be any Disneyism to alert the
ebay police.

Now, that's not to say they won't call you on it. Disney, Coke, Nickelodeon,
etc - all these companies have loads of servants trolling the internet
looking for things like this. Their entire lively hood is wrapped up in
protecting their name and images. People have gotten in trouble for
using the Coka-cola font on t-shirts.

It's your call - you can do it, but there is always the chance that
you could get in trouble with ebay too, and ebay is known for
shutting down people and asking questions after the fact.
They are not very fair when it comes to the little guy.
Even if the little guy happens to be a power seller.

One of the most important phrases artist need to learn is "Don't F%@K with the mouse!".

There was a nursery school that had painted a wall in one of their rooms with Disney characters and they got hit with a copyright or trademark suit, I can't remember which and where forced to paint over it.

Disney is a very active VERO on eBay. They are pretty nasty. They can shut down your entire eBay account.

However, you could probably make beads and call them things like "mouse ears" and "mouse bows".

I did see someone selling such things on Just Beads recently they were calling their bead sets things like "Minnie's Wardrobe".

Hmmm. . . I wonder if Disney has copyrighted the word "mouse":-P

Keep in mind, it's not just that Disney *enforces* the laws against artists, they work to *change* the laws against artists. Google the "mickey mouse protection act" which was passed into law, extending copyrights in a crazy manner, without even the smallest effort to protect public domain.

One of the simplest changes that could be made would be a $1 required copyright extension filing to have a copyright extended past 20 years, but corporations have fought even that.

Keep an eye on these jerks. Eyes on the Prize, the award winning civil rights documentary was out of print for about 10 years because of copyright problems. It will only get worse if artists, writers, filmakers, and programmers work to keep the advantages of the public domain and sensible copyright in the minds of lawmakers.

Well, I have to say I did not know of all this. I knew it probably was not a good idea, but I thought maybe there was something I didn't know because of the others I have seen here and there doing similar things. Thank you all for letting me know this and for saving me from myself. There is no way I am going to touch this one with a 10 foot pole.

I knew it probably was not a good idea, but I thought maybe there was something I didn't know because of the others I have seen here and there doing similar things. Disney hires glass artists who only work for them. Lance at Flame Tree ,I think told me he was asked once but who wants to sit and make the same thing all the time. They are not allowed any artist interpretation. It has to be exact. Wouldn't that be boring?

Awww...Kevan, thank you. You know the funny thing is, I'm surprised they don't just use molds for all of the stuff. I would think even the hands of a lampworker would not be accurate enough for them. I have an embroidery machine that sews amazing designs that you can change. You can make them smaller or larger or mirror image them. The machine that I own is a Brother Inovis Disney version. You can't even flip a Disney design around to face the other way. You can't size them or do anything to them. You can only use them as they are.

I have seen the Minnie and Mickey beads on ebay recently.

I myself have sold a set of beads that looked like Pepsi bottles - I did not use the word Pepsi - just cola.

The risk is high. I know around here locally, (near the Planter Peanut factory) that a pawn shop had a wood cutout of a figure that looked like Mr. Peanut and it wasn't even for sale and Planters had a fit.

Hope they don't see the stained glass of Mr. Peanut on my back door.

I think it is safe to make such stuff for your own use but not to sell.

I do contract voice work on the side for Disney (I'm one of those voices you hear at Disney Themeparks). They are rabid when it comes to anything that looks (or sounds) like copyright infringement. At one point, they even TRIED to demand that I only do work for them since my voice was at many key places in the parks -- but they didn't want to pay me, except for the studio time it took to record. Yeah right! Thank the gods California is a "right to work" state and they can't impede me from making a living (unless they want to pay).

Even faxing back a contract to Disney, I attached a handwritten note with a a smiley emoticon that I had put two small ears on -- they called me back demanding it was an infringement. As was said before, artists can expresss their own freedom, but don't EVER FUss with The Mouse!

Now back to your regularly scheduled programming...! ;-) (sans ears!)

Jim, are you sure you're allowed to post that message? It probably contains some of the words that you used when you recorded the voices at Disney -- or at least words using the same letters as words you recorded at Disney -- so from now on, Disney owns everything you say. And write. You can probably still think, as long as you don't think in words, or think of Disney characters, or think of any of the colors that Disney uses. Or, God forbid, have that "It's a Small World" song playing over and over and over and over and over and over in your head . . .

Do you get the feeling that when "Shrek" came out (the original one) Disney employees must have been screaming and hooting and stamping their feet? And that hidden away in whatever passes for basements in California, Disney artists must have truckloads of really, really funny Disney parody art that outsiders (and Disney management) will never see?

alot of people who worked at Disney left adn went to work at Dreamworks on Shrek :-)
and yes, there is alot of parody work but mostly teasing each other

Hidden away? I guess you never saw the original artwork on the cover of "The Little Mermaid" VHS tape. It was the infamous penis castle. I have a copy - but only because I bought it for my daughter:lol:

You know they're claiming that's just an "accidental resemblance." Yeah, sure . . . I wonder if the guy who drew it (it had to be a guy who drew it) has suffered an "accidental death" since Disney noticed what was really behind Ariel's decision to leave behind her little friends in the sea. Talk about "messing with The Mouse" -- that guy must have had a serious death wish.

Half the people here probably own a copy of the video -- and most of them probably never noticed that -- um -- "coincidental similarity."

(So, did you buy the video for your daughter before or after you got a good look at the castle? Do you buy a lot of penis art for your daughter?:wink: )

Yep - that's the one! Well - my daughter is 14 now so she'll have to go buy her own penis art:-P

The story I heard was that this was the artist's prank on his last project before he left to work for someone else.

Either way, it's hilarious! (Though I may have been more upset if I bought the tape for my kid or something.)

You think Disney would prosecute copyright infringement on penis castles? Hmmm.... :lol:

I know everyone is bashing Disney, but did you ever think of approaching them and making the beads to sell as souvenirs at the parks? Then you would both make out. People would just eat them up!!!

Instead tickking them off and saying that you already make these things, why not show them a series of very detailed characters that you make up yourself and explain your idea and how well this idea would sell at the parks.

I remember seeing a shop at Disney where the guy did magic tricks and then you could by the trick. You could do demos and then sell the beads. Just have a really good lawyer check the contract before you sign...

l used to work for Time/Warner and the nicknames we use for the company were "The Velvet Prison" and "Golden Handcuffs".

I'd be very careful about what you do. These companies have lots of lawyers and they take these things very seriously.

And how do we all feel when an importer steals an original bead idea they saw on ebay and mass produces it in India or China?
